Terms and conditions

The Bullcare Service is provided by Bullcare SRLs, via Dei Longobardi 7, Benevento (BN) 82100 tax code and VAT number 01827720622, (hereinafter the “Bullcare”).

The General Conditions of Service are specified below, the acceptance of which by you is an essential condition for you to be able to validly use the Bullcare Service.

GENERAL CONDITIONS OF SERVICE

In order to allow you to register for Bullcare services and allow you to access them, we ask you to read and accept the General Conditions of Service which govern access to the services offered. At the time of registration and registration of your personal data, you will declare that you are of age and that you have read the General Conditions of Service, which we ask you to expressly accept by electronic subscription, during the "Registration" phase. The declaration of having carefully read the General Conditions of Service and their acceptance is a necessary and indispensable condition for access, use and enjoyment of the services offered by Bullcare SRLs. through the website www.bullcare.it (hereinafter “the Application”). When signing the General Conditions of Service you will also be asked to read the information relating to the processing of your personal data pursuant to Legislative Decree no. 30 June 2003. 196 and subsequent amendments, and you will be asked to authorize the processing of your personal data, freely provided, for the purposes relating to access to services and for any other initiatives to which you may choose to participate, as well as expressly accepting the specifically indicated clauses.

THE ROLE OF BULLCARE

Bullcare represents an Application where Users make use of the booking and purchase service of pet products and receive the purchased product at home. A virtual place is therefore provided where the User has the opportunity and the tools to choose products intended for the care and well-being of animals, as well as objects useful for applying the products. The data relating to the product will be visible to the User on the detail pages of each product.

  1. Registration and acceptance of the General Conditions of Service

To have access to the features and services of the Application, you must register, which is also an essential operation to make a purchase or any activity offered by Bullcare SRLs.

To proceed with registration, you will initially only be asked for the user's name and email address.

To complete registration, when purchasing the plan you will be asked to enter:

  • first name;

  • surname;

  • address for possible invoicing;

  • delivery address;

  • e-mail;

  • password;

  • telephone.

With each purchase you will be asked to click on the "I have read and accepted the Privacy Policy and the General Conditions of Service" link. By doing so, you declare that you have carefully read and expressly accepted all the Conditions, terms and methods of use and enjoyment of the services as expressly indicated below and that you are aware of all the characteristics and purposes of the services.

Username and password provided by you are personal and cannot be used by any other third party to access the Bullcare services.

The User undertakes to keep his Username and password and not to allow third parties to use them. The User undertakes not to register more than once and not to register accounts with the aim of abusing the functionality of the application. Upon completing registration, the User undertakes: not to provide false or misleading data, including false names, addresses and contact details, as well as undertakes not to fraudulently use credit or debit card numbers, not to attempt to evade the security measures of the Application or to violate the network, use the services of the Application for purposes other than commercial transactions, engage in any illegal activity in connection with the use of the Application and/or the services offered by Bullcare. The User is solely responsible for the conservation, confidentiality and use of his/her email and password and, consequently, by registering the same, he/she exempts the Application from any liability deriving from improper use of the password itself, from third parties who have become aware, in any way, of the password relating to the User. The User, as soon as he becomes aware of it, undertakes to immediately communicate to Bullcare, via e-mail at info@bullcare.it , attaching a copy of a valid identity document - the theft and/or loss of the access data (Username and/or password) and/or unauthorized disclosure and/or unauthorized use by third parties of the account and/or password. Following the Bullcare report. will proceed to deactivate the registration and delete any content. The absence of reporting and subsequent disabling will determine the User's direct and exclusive responsibility for all uses and/or abuses of his Username and/or password.

The User may request the cancellation of their registration and data at any time by sending a communication to Bullcare at the following email address: info@bullcare.it . Your agreement with Bullcare will terminate immediately upon receipt of your request to terminate this agreement and your Username and password will be deleted.

It is understood that Bullcare will in no case and for any reason be held liable towards the User or third parties for the modification, suspension, interruption and/or termination of the services. The Application does not guarantee that the services offered therein, or the Application itself, are free of viruses or other elements that may cause detrimental effects on any technology.

Following registration, the Application is entitled to send the User e-mails with administrative and promotional content, information relating to account activity and purchases, updates regarding the Application and related services, other promotional offers, information on purchases made by the User himself. The User can at any time opt out of receiving promotional emails by clicking on the "unsubscribe" link at the bottom of emails with promotional content. Furthermore, the Application, corresponding to this registration procedure, invites the User to consult the Privacy Policy, which constitutes an integral part of these General Conditions of Service.

Object of Bullcare services

The Bullcare Service consists of:

  • booking and purchasing services via IT platform;

  • supply of high quality pet products;

  • home delivery of the above products.

2.1 The Purchasing Service:

Following successful registration on the Website by the Registered User, the Registered User will purchase the Products

the user :

    • guarantees the availability of the sum necessary for the payment of the Products ordered through the portal

    • expressly authorizes the Company or third parties authorized by it to store the credit card identification on their systems in order to allow the same to be repurchased in a facilitated manner;

    • expressly authorizes the Company to make the receipt of the Service available on the personal Profile ("Personal Area" section) and/or via e-mail;

    • expressly authorizes the Company or third parties authorized by it to credit the amount for purchases according to the payment method indicated at check-out.

All prices include VAT. The cost of delivery is €6.90, unless otherwise specified. All products and prices indicated in the Application constitute an offer to the public with the limitations and methods contained in the Application and in these General Conditions of Service. Given the nature of the products sold through the Application, the graphic design of the products delivered may not coincide with that represented on the Application at the time of purchase.

The products may have a variable weight, the actual weight of which compared to that indicated on the label may vary up to 20% more or less than what is indicatively proposed in the Application. Bullcare, therefore, cannot be held responsible in any way for any variations in the Products published through the Application.

Under no circumstances Bullcare. may be held responsible for failure or incorrect compliance by the User with any legal or regulatory procedure in relation to the Agreement.

Users are aware that all costs relating to the equipment and software programs necessary to activate and establish the connection to the application and all costs relating to connection to the network are their exclusive responsibility.

Access to the service: Bullcare has defined a welcome discount applicable exclusively to the first order placed on the Application by each user.

Referral: Bullcare has developed a referral system intended in this sense: User1 offers a discount code to User2; once User2 uses the code by completing a purchase on the Application, User1 also receives his discount code. User2 can only use the discount code once, while User1 can send the discount code to multiple users and receive as many discount codes as many users use it.

Satisfied or refunded policy: Bullcare has defined a refund policy in the event that the products do not work, demonstrating with photographs and carefully explaining the process used.

The policy guarantees the User the possibility of having a refund of a sum equivalent to the value of the order, excluding shipping costs.

In the event that the User chooses to receive a refund, he or she is required to send the remaining product to the operational headquarters of Bullcare SRLs indicating on the package:

Shipping costs are the responsibility of the user. Each user can benefit from the policy when ordering a new product for the first time.

Purchase by minors

The system does not allow the online purchase transaction to be completed if performed by users under the age of 18 as registration is required by an adult and, in the case of online payment directly on the Application, the credit card credit will necessarily be made out to an adult.

  • Confirmation of purchase

If the payment is successful, the system displays the purchase receipt online, which will bear the indication "Payment Confirmed - Transaction Complete" and confirms the purchase made by the User.

Within approximately 30 minutes of completing the transaction, the User will receive an email confirming the purchase made, specifying the price paid and the method of collection or delivery of the selected and booked products. Bullcare declines all responsibility for the failure to deliver the confirmation email within the aforementioned terms, where its delivery was not made possible due to the User entering incorrect or invalid data in the online form. request line for the User's personal data.

The order sent by the User will be binding for Bullcare only if the entire order procedure has been completed regularly and correctly without any error reporting by the Application. Bullcare will not include products not expressly booked by the User in the order.

4.1 Invoice request

In relation to the provisions of resolution no. 274/E of 2009 of the Revenue Agency, indirect electronic commerce operations are similar to mail order sales and, therefore, are not subject to the obligation to issue an invoice (unless requested by the customer no later than the moment of execution of the 'operation), as provided for in Article 22 of Presidential Decree 633 of 1972, nor to the obligation of certification by issuing the receipt or tax receipt pursuant to Article 2, letter oo), of Presidential Decree 21 December 1996, n. 696.

In the event that the User requires an invoice it will be necessary for the User to fill in the appropriate fields useful for invoicing present within the reserved area of ​​the Bullcare Application or request it via email. It will therefore be necessary to provide the Tax Code or VAT number, so that Bullcare can subsequently issue a valid invoice by sending it to the address info@bullcare.it , taking care to specify in the subject of the email "Invoice issue request" .

  • Terms of payment

The User can complete the purchase on the platform exclusively by entering their credit card details: the payment data will be transferred via a protected connection in SSL (Secure Socket Layer) encryption compliant with PCI DSS (Payment Card Industry Data Security Standard) regulations. ), to Stripe for authorization and billing, and subject to the Privacy Policy for Stripe Services. For security reasons, Bullcare does not store or process any of this data directly. The relationship between the User and Stripe regarding the payment of the Products is direct. Please note that for each transaction code the User has 4 payment attempts available. Once 4 unsuccessful payment attempts have been made, it will no longer be possible to recover the transaction. As an exception, payment may be requested by bank transfer or other methods such as cash payment.

  • Shipping and delivery methods of products

Bullcare will deliver the products booked between 9:00 and 18:00. For organizational and service efficiency reasons, the product cannot be verified or controlled by the User at the time of delivery. For any anomaly found, contact Bullcare at the email address info@bullcare.it , which will act, where possible, promptly to verify and resolve any anomalies.

Bullcare will not be responsible for any delays occurring during transportation or delivery.

Likewise, Bullcare cannot be held responsible for any loss, damage, incorrect or non-delivery caused by events and/or causes of force majeure or unforeseeable circumstances, such as but not limited to: natural disasters, adverse weather conditions (such as intense snowfall), any strikes (of its own or other employees), accidents to means of transport, explosions, or any other cause, similar or different.

Bullcare will not be in any way responsible for the temporary or permanent unavailability of one or more products. In the event of unavailability, even temporary, of the requested products, Bullcare undertakes not to charge the User the corresponding price.

For delivery, the presence of the User or his representative at the address is required. If the User (or the person in charge) is not present, the order will be considered canceled and the User will be charged (as a penalty, even on subsequent expenses) the cost of delivery and that of the products no longer alienable to third parties ; Bullcare will also have the right to exclude the User from the service or make the provision of the service subject to online payment.

Bullcare reserves the right to evaluate, on a case-by-case basis, the possibility of not charging the User for the cost of delivery and products that can no longer be sold to third parties.

  • Access to Bullcare Services

In order to access the Bullcare Services, the User is required to:

  1. accept these General Conditions of Service in all their parts;

  2. complete the request for the User's personal data in the Application, authorizing its processing by Bullcare
    in accordance with the Privacy Policy published on the Application and on the web page

By accepting these General Conditions of Service, the User undertakes to keep his registration data constantly updated and guarantees that they are valid, truthful, accurate and correct and do not violate the rights of third parties.

Failure to fill in all the fields indicated as mandatory in the online form requesting the User's personal data will not make it possible for the User to use the Bullcare Service. In any case, Bullcare reserves the right to allow access to the Service at any time exclusively to users who have previously successfully completed a registration procedure on the Bullcare Application. In this case, upon completion of the registration procedure the User will also provide his/her email address (“User Name”) and a personal access password (“Password”). The Username and Password are personal, cannot be used from two locations at the same time and cannot be transferred or given to third parties. The User will be entirely responsible for all operations carried out using their Username and Password and it will therefore be the User's obligation to keep these data strictly confidential and secret by immediately notifying Bullcare in the event of their use without the User's authorization. Each User will be held fully and completely responsible for any act or fact performed using their Username and Password and Bullcare cannot be held responsible in any way for any incorrect or illegitimate use of the Username and Password carried out by users or by any third party.

Bullcare also reserves the right to inhibit a User from accessing the Bullcare Service as well as to interrupt the operation of his Username and Password immediately and without notice in the event that it believes that there is a substantial violation of the provisions set out in the these General Conditions of Service, in particular if you find that: (a) the User's data is not updated; (b) liability has arisen related to the unlawful use of the Username and Password; or (c) in case of distorted use or for illicit purposes of the Bullcare Service by the User.

Bullcare undertakes to cooperate, collaborate and operate, in any way, with all competent authorities, including judicial authorities, where they order or request the Bullcare Service to communicate the identity or location, as well as further data, of anyone is responsible for any IT infraction (fraud, etc.).

  • Complaints

For any observation or complaint relating to the Bullcare Service, please send an email to the email address: info@bullcare.it . All requests will receive a response within approximately 72 (seventy-two) hours of receipt.

User comments are always very useful, as they are an important moment of discussion that allows us to offer a service that increasingly corresponds to user needs.

  • Bullcare Limitations of Liability and Rights

Bullcare assumes no responsibility for direct and indirect damages, of any nature, suffered in relation to the services provided by it, not directly and exclusively attributable to Bull care. Bullcare also reserves the right to withdraw, modify, suspend or discontinue any function or service related to the Bullcare Service for its own technical or organizational reasons.

Bullcare reserves the right, whenever it deems necessary, to amend and/or integrate these General Conditions of Service. The updated version of the same will however always be available on the Application.

The User acknowledges and accepts that Bullcare cannot in any case be held responsible for any type of damage, direct or indirect, deriving from the User or third parties: a) from the use or inability to use the services; b) from any modification, suspension or interruption of services; c) from messages received or transactions carried out by Bullcare through it; d) from unauthorized access or alteration of the User's transmissions and/or data, including among other things any damage, including economic, suffered by the User due to loss of profit, use, loss of data or other intangible elements.

The User, without prejudice to any other provision of this Agreement, expressly acknowledges and declares that: a) the use and use of the Bullcares services is at his own and exclusive risk and is provided by Bullcare on the basis of an exclusive assumption and total responsibility of the User; b) Bullcare is exempt from any type of responsibility and guarantee, express or implicit, including the guarantee on the continuity, quality or quantity of the services, c) any material downloaded or otherwise obtained through the use of the services will be done at the choice and risk of the The User and therefore all responsibility for any damage to computer systems or loss of data resulting from the loading and/or downloading of material will fall on the User; d) Bullcare assumes no responsibility for any damage, loss of data, information, damage due to delay or loss of opportunity, incorrect or failure to obtain information, restrictions or loss of access, difficulties or problems of any kind, errors, unauthorized use during access to the services or in relation to other forms of interaction within the services. Furthermore, the User is and will be solely and directly responsible for maintaining and saving the data and information contained in the services.

Bullcare will also not be responsible for the truthfulness and correctness inherent in the information (allergies, dietary regimes, etc.) contained within the descriptive pages relating to the foods and products that can be booked through the Application.

Bullcare declines all responsibility for direct or indirect damages of whatever nature or in whatever form they manifest themselves, resulting from the use of the Application and/or the news, photos and information contained therein.

  1. Withdrawal and exclusion of the right of withdrawal for certain goods

The User's rights are protected by Legislative Decree no. 206/2005 and subsequent amendments. All the goods offered by Bullcare fall within the scope of application of the art. 59 of the Consumer Code, which provides for cases of exclusion of the right of withdrawal for certain goods.

The User does not, therefore, have the right to withdraw from the contract.

The right of withdrawal is not permitted in the cases referred to in the art. 59 of Legislative Decree no. 206/2005, such as, for example and not in an exhaustive manner, the case of purchase of goods:

  • packaged, sealed, opened by the User;

  • which by their nature cannot be returned or are likely to deteriorate or expire rapidly;

  • tailor-made or clearly personalized.

  1. Limitation of Bullcare Warranties

Bullcare does not provide any type of guarantee as to whether the services correspond to the User's requirements and/or expectations.

The User acknowledges that access to Bullcare services, storage, publication and dissemination of the contents sent is done at his/her own exclusive risk.

Furthermore, Bullcare does not provide any guarantee towards the User regarding the results that can be obtained with the use of the services, or regarding the truthfulness and/or reliability of any information, data or news obtained by the User for the through services.

The Products listed on the Platform are intended for animals that do not have food allergies or intolerances and that are not in physiological conditions such as to make them exposed to risks linked to the intake of particular foods. The information on allergens present in the ingredients of the dishes is provided for information purposes, but the methods of preparation of the Products are not such as to be able to exclude cross-contamination. Therefore, even Products for which specific ingredients or allergens are not indicated could have been contaminated without this being considered a responsibility of Bullcare.

Bullcare assumes no responsibility for direct damages that are not directly attributable to it. The extent of the damage may never exceed the price paid for the order of the Products. Bullcare assumes no responsibility, contractual or extra-contractual, for indirect and consequential damages of any nature relating to orders or even the sole use of the Platform.

  1. Personal data and content of the Application

Bullcare will process all personal data provided by Users at the time of registration in full compliance with the provisions contained in Legislative Decree no. 30 June 2003, n. 196 (containing the “Code regarding the protection of personal data”), according to the methods and for the purposes indicated in the information provided to the User pursuant to art. 13 of the Code as affixed at the bottom of this contract.

Having read the information pursuant to art. 13 of Legislative Decree no. 196/2003 and by signing this contract the User expresses his express consent to the processing and communication of data concerning him in the manner described in the aforementioned information, indemnifying the other party from any civil, criminal or administrative liability for damages that may be suffered as a consequence, occasion or connection with said processing, undertaking towards said party to communicate without delay any modification of the data provided to it, by registered letter with acknowledgment of receipt addressed to the person to whose attention the communications must be addressed pursuant to the aforementioned legislation.

It is understood that the User authorizes Bullcares to profile his personal data for the processing of statistical data in order to be sold for commercial and business operations of Petco Srl

All rights reserved. In particular, all intellectual property rights (such as copyrights, patents, trademarks, service marks, commercial brands, designs, both registered and unregistered) present on the Bullcare Application, as well as all information content published or the access to which is permitted through the services provided by the Bullcare Service itself, all databases managed by Bullcare, texts, graphics, software, photos, videos, music, sounds, underlying source codes and all software, and in general all the information offered and contained in the Application is the property of Bullcare.

All material listed above may not be reproduced, redistributed or copied, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, bought, sold, rented, sub-licensed, used to create derivative works, or exploited in any manner in the absence of the prior and express authorization of Bullcare. It is permitted to find and view the content of the Application on the screen of a PC, tablet or smartphone, store the content in electronic form on a disk (however not on a server or on a storage device connected to a network) or print a copy of such content solely for your personal, non-commercial use, provided that you keep intact all copyright and other proprietary notices.

It is prohibited to reproduce, modify, copy, distribute or use the materials or content of the Application for commercial purposes without prior and express authorization from Bullcare.

All rights, including goodwill and, if any, trademarks, in the names of the Application are owned by the Bullcare Service. The other names of goods and products, as well as the company names mentioned on the Application, even if they represent trademarks, registered or unregistered, are the exclusive property of their respective owners.

The Application reserves the right to control the comments left by users following the purchase of goods and products, avoiding the publication of comments that are not in keeping with the character of the Service offered by the Bullcare Service.

  1. Variation of Terms and Conditions

Bullcare reserves, as indicated below, the right to update, integrate and modify in whole or in part the terms of these T&Cs and each of the documents referred to therein, including the Privacy Policy, the Services and their respective characteristics, as well as, by way of example and without limitation, the fees for the use of the Services published therein.

The User undertakes to periodically review the T&Cs, without prejudice to the fact that the Company will do what is reasonably necessary and appropriate to bring the User to the attention, via the Website itself, of any changes to the T&Cs and/or the Services. .

Changes to the T&Cs and/or the related Services will be effective from the moment of publication on the Website and will apply only to sales concluded subsequently.

The Company will inform Users of changes to these T&Cs or to the functionality/limitations of the Services and/or their costs by publication on the Website and, for Registered Users, by means of a specific communication sent to the email address of the indicated User. when registering on the Website and/or subsequently.

Changes and updates will be deemed accepted by Users by connecting to the Website or using the Website after the modification has been published on the Website itself.

If the User does not agree with the changes made, he is invited not to use the Website and, if he is a Registered User, he can proceed to cancel his account by accessing the "Personal area" section of the Website by clicking on “Account” and then on “Delete Account”.

  1. Applicable law and competent court

The applicable law, to these General Conditions of Service, as well as to all legal relationships existing between the Application and the Users, the Navigators - Consumers, and the Customers - Sellers, connected to the services offered by Bullcare, is Italian law.

For the legal relationships between Bullcare and Users, please refer in particular to the legislative decree of 6 September 2005, n. 206, containing the "Consumer Code", and subsequent additions and amendments, including Legislative Decree 21 February 2014, n. 21 “Implementation of Directive 2011/83/EU on consumer rights, amending Directives 93/13/EEC and 1999/44/EC and repealing Directives 85/577/EEC and 97/7/EC”.


SPECIAL CLAUSES

Pursuant to and for the purposes of the articles. 1341 and 1342 cc, the following clauses are expressly accepted: 2 (Subject of Bullcare Services); 4 (Confirmation of Purchase); 8 (Access to Bullcare Services); 9 (Limitations of liability and rights of Bullcare); 10. Withdrawal and exclusion of the right of withdrawal for certain goods 12 (Personal Data).

DEFINITIONS

For the purposes of the interpretation and execution of the above General Conditions of Service, the following definitions apply, in addition to those possibly contained in the legal texts:

  • Application: set of web pages, accessible at the URL: http://www.bullcare.it and in the future through other platforms, through which Bullcare offers its services.

  • Bullcare: the entity that provides the Services, owner of the Application and the domains from which it is accessible. For the purposes of these General Conditions of Service, Bullcare SrlS, with registered office in Via Dei Longobardi 7 Benevento 82100 BN, registered in the Company Register of Benevento, tax code and VAT number 01827720622, will be considered.

  • Password: confidential and personal component of the authentication credentials, essential for the User's use of the Application Services.

  • Registration Procedure: set of activities which consist, as far as the User is concerned, in filling in a form, in reading the privacy information and in expressing the relevant consent, as well as in reading and accepting the General Conditions of Service, in sending this information, which constitutes the "registration request" to be considered as a contractual proposal. As regards the Application, the procedure involves receiving the registration request and communicating the receipt to the User.

  • Services: the services provided by Bullcare - both free of charge and for a fee - to the User, within the limits and according to the methods set out in the General Conditions of Service.

  • User: navigator who has successfully completed the registration procedure and who can use the services offered by Bullcare on the Application pages.
